Реализация конституционной свободы преподавания и научного творчества в сфере управления высшим образованием

Abstract

The article is devoted to the research of some problems connected with differentiation of powers in the sphere of management of higher education in Russia. The author proves that institutions of local government of city and rural settlements, as well as intercity areas of city districts are completely excluded from control system of education. The similar legislative decision is constitutional and democratic, as these municipal formations have joint territories with other municipal formations. The question concerning intercity territories of cities of federal value look more difficult: these subjects of local self-government have no joint territory with other municipal formations; their exception of sphere of regulation of item 9 of the Federal Law «About education in the Russian Federation» would mean, that they are completely deprived of guarantees which city districts and municipal areas have.
