Проблемы правового регулирования исполнения государственного контракта на поставку продукции заключенного по результатам электронного аукциона

Abstract

The article is devoted to the enforcement of the state contract for the supply of goods for state needs concluded in accordance with results of the electronic auction, established in light of the Federal law "On contract system in procurement of goods, works, services for state and municipal needs". Based on the analysis of legislation and judicial practice the authors identify the main problems of law enforcement: examination of results of execution of the state contract, unilateral refusal of execution of obligations under state contract, the possibility of replacement of supplied products in a similar and monitoring the enforcemenr of the contract.
