Соотношение медицинского и юридического критериев дееспособности граждан

Abstract

n the article the analysis of legal construction features of institute of legal capacity as an important component of institute of legal personality is carried out. Authors consider medical and legal (intellectual and strong-willed) criteria of legal capacity and their influence on volume and degree of legal capacity of citizens. Also specifics of each of these criteria in relation to restriction of the full age citizen in legal capacity and to recognition its incapacitated are investigated. On the basis of the revealed problems in the considered legal area conclusions and recommendations about improvement of the current legislation are formulated.
